Welcome to Bay. We’re glad to have you here! These terms of service (the “Terms of Service” or “Terms”) are a binding agreement between you and Bay (referred to as “we,” “us,” or “our”). These Terms describe the rules and conditions that govern your use of our bot and any related services (collectively, “Bay” or the “Services”), and hereby incorporate our Privacy Policy.

By accepting these Terms or accessing our Services, you confirm (i) that you are at least 13 years of age, (ii) if you are the age of majority in your jurisdiction, that you have read, understood, and agree to be legally bound by these Terms and the Privacy Policy, and (iii) if you are under the age of majority in your jurisdiction, that your legal guardian has reviewed and agreed to the Terms and Privacy Policy. If you do not agree to these terms, please do not use the Services.

The Services may only be used within the scope outlined in these Terms and in compliance with applicable law. By accessing the Services, you agree not to use them in a manner that:

• – Violates these Terms or any applicable laws or contractual agreements, including the Discord Terms of Service at https://discord.com/terms;
• – Infringes on the intellectual property rights of any party (including us);
• – Is abusive, defamatory, fraudulent, obscene, or otherwise inappropriate;
• – Puts your account or another user’s account at risk (e.g., by exposing login credentials);
• – Attempts to obtain passwords, accounts, or other private information from other users;
• – Interferes or attempts to disrupt the proper operation of the Services;
• – Exploits or publicly discloses any error or bug that may provide an unintended advantage;
• – Impersonates the Services to deceive other users;
• – Involves the development, distribution, or use of unapproved software that interferes with the Services;
  • – Involves unauthorized exchange of virtual currency or goods outside the Services;
• – Or supports or condones any user who violates these Terms.

We reserve the right to suspend or terminate your access to the Services immediately, without prior notice and at our discretion, if you violate any of the above conditions, these Terms, or are found to support or condone behavior from another user that violates these Terms.

Bay is intended to be used by humans only. To ensure a fair experience for all users, you agree not to develop, distribute, or use software that automates interactions with the Services, including (but not limited to):

• – Self-bots or any program that automates user interactions.

• – Auto-spamming or auto-sending of messages;

• – Auto-farming or auto-collecting any virtual goods or currency;

The Services may provide opportunities to obtain virtual currency (e.g., “Pearls”) or virtual goods (e.g., “Fishies,” “Fragments”). These items are exclusively for use within the Services and are not tradable or exchangeable outside of Bay. Unapproved exchanges include, but are not limited to:

• – Exchanging virtual currency for real-world currency (e.g., USD, EUR);
• – Exchanging virtual currency for cryptocurrency;
• – Transacting virtual goods on third-party platforms, games, or other Discord bots.

Violation of these policies may result in account suspension. We reserve the right to modify or remove virtual goods or currency as deemed necessary.

While Bay provides free basic functionality, certain features or items may be available as paid services (“Paid Services”). Prices, durations, and other conditions are outlined within the Services and are subject to change without notice. Fees, taxes, and other costs are displayed during the purchasing process.

Billing
We use a third-party payment processor (“Payment Processor”) for transactions. Your use of this service is subject to the processor’s terms and policies.

Refunds
Refunds or credits for fees are not guaranteed. We reserve the right to deny a refund at our discretion.

Liability and Indemnification

Disclaimer of Warranty

THE SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. USE OF THE SERVICES IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to indemnify us from any claims, damages, or losses arising from your use of the Services or violation of these Terms.

Service Interruption
We may occasionally interrupt the Services for maintenance. We may also discontinue the Services with notice to allow users to withdraw personal data, as applicable by law.

Changes to These Terms
We may update these Terms at any time. Changes will be posted at https://bayofficial.net and become effective upon posting. If you disagree with any changes, please discontinue using the Services.
